Terms of Service

1. Acceptance of Terms

By accessing or using BrengX ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

BrengX is a delivery platform that connects customers with restaurants, grocery stores, pharmacies, and other merchants ("Business Partners") through independent delivery drivers ("Drivers"). We facilitate orders but do not prepare food or perform deliveries ourselves.

3. User Accounts

Account Creation

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • One person may have multiple accounts for different roles (customer, driver, business)

Account Responsibilities

You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.

4. Orders and Payments

Placing Orders

  • Orders are subject to acceptance by Business Partners
  • Prices displayed include applicable taxes unless otherwise stated
  • Delivery fees are calculated based on distance and delivery type
  • Priority Delivery incurs additional charges as displayed at checkout

Payment

  • We accept credit/debit cards and cash on delivery
  • Card payments are processed securely through Stripe
  • All prices are displayed in Surinamese Dollars (SRD)
  • You agree to pay all charges at the prices listed

Cancellations and Refunds

  • Orders may be cancelled before the Business Partner begins preparation
  • Refunds for quality issues are handled on a case-by-case basis
  • Contact customer support for refund requests

5. For Business Partners

Registration Requirements

  • Must provide valid KKF uitreksel (Chamber of Commerce extract)
  • Must maintain accurate business information and menu items
  • Must comply with all applicable food safety and business regulations

Business Responsibilities

  • Prepare orders accurately and in a timely manner
  • Maintain food quality and safety standards
  • Update menu availability and prices regularly
  • Handle customer complaints professionally

6. For Drivers

Driver Requirements

  • Must be at least 18 years old with valid identification
  • Must have valid driver's license and vehicle registration
  • Must maintain adequate vehicle insurance
  • Must pass document verification before accepting deliveries

Driver Responsibilities

  • Deliver orders promptly and safely
  • Handle food with care and maintain hygiene
  • Follow all traffic laws and regulations
  • Treat customers and Business Partners with respect

Earnings and Withdrawals

  • Drivers earn credits for completed deliveries
  • Withdrawal requests are subject to admin approval
  • Cash pickups are available at designated locations

7. Prohibited Conduct

You agree not to:

  • Use the Platform for any illegal purpose
  • Impersonate another person or entity
  • Interfere with the Platform's operation
  • Attempt to gain unauthorized access to our systems
  • Submit false or misleading information
  • Harass other users, drivers, or Business Partners
  • Use the Platform to transmit harmful content

8. Limitation of Liability

BrengX is a platform connecting customers with Business Partners and Drivers. We are not responsible for:

  • The quality, safety, or accuracy of products from Business Partners
  • Actions or omissions of Drivers during delivery
  • Delays due to circumstances beyond our control
  • Losses resulting from use of the Platform

9. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is the property of BrengX or its licensors. You may not use, copy, or distribute this content without permission.

10. Termination

We reserve the right to suspend or terminate your account for violation of these terms, fraudulent activity, or any other reason at our discretion. You may also delete your account at any time.

11. Dispute Resolution

Any disputes arising from these terms or use of the Platform shall be resolved through good-faith negotiation. If resolution is not possible, disputes shall be submitted to the appropriate courts in Suriname.

12. Changes to Terms

We may modify these Terms of Service at any time. Continued use of the Platform after changes constitutes acceptance of the new terms.
